What is the time limit to claim compensation for a taxi accident?

You normally have 3 years from the date of any kind of personal injury to claim compensation. However, there are some circumstance where you might have longer to claim.

If you only became aware of the injury later – The 3-year time limit will be counted from this date instead, referred to as the ‘date of knowledge’.

If the injured party was under 18 – Their parents or guardian will have until the child turns 18 to bring a claim. Once the child turns 18, they can bring their own claim up until their 21st birthday.

If the injured party does not have the mental capacity to make a claim – There is no time limit for someone else to claim on their behalf.

If you need to claim for someone who has died – You will usually have 3 years from the date of death to make a claim.

How much compensation can you claim for an accident in a taxi?

Can you claim compensation if you are injured in an Uber?

Because Uber and other similar ride-sharing apps do not work the same as traditional taxi companies, people are often confused about who they can claim against if they are injured as a passenger in an Uber or car hired through a similar service.

Uber drivers are required to have insurance and in the first instance you will normally claim against the Uber driver or the driver of whichever vehicle was responsible for the accident.

However, the issue of whether Uber drivers are considered employees of Uber is at the centre of an ongoing legal battle involving the company. This could have implications for whether Uber could ultimately be held responsible for injuries suffered by passengers of cars hired through the app.

The Court of Appeal ruling in December 2018 that Uber workers should be classed as workers, potentially opening Uber up to claims for passenger injuries. However, Uber has stated its intention to challenge this in the Supreme Court, meaning the matter is not yet settled.
